10-Year-Olds Accused in Homeless Beating

Another shocking story of brutality just for the hell of it!
To me it seems as if justice will not be meted out fitting the crime. I personally don't give damn what age the perpetrators are! Their actions should be dealt with severely before they commit even worse crimes. What do you think?
DAYTONA BEACH, Fla. (AP) - A homeless Army veteran was recovering in a hospital Friday after two 10-year-old boys and a teenager were accused of attacking him on a street and smashing a concrete block into his face.
The three boys were in custody on aggravated battery allegations and face a hearing next week to determine if they should remain in juvenile detention.
At their first court appearance, the two younger boys were escorted from jail in oversized white jumpsuits, their hands chained in front of them and their legs in shackles.
"They are dangerous," the 57-year-old victim, John D'Amico, told The Associated Press from his hospital bed. "The street doesn't need them. They need to be somewhere."
Prosecutors will petition the court to charge the 17-year-old as an adult, State Attorney John Tanner said. If convicted, he would face up to 15 years in state prison.
The 10-year-olds are too young to be charged with assault as adults under state law, prosecutors said.
D'Amico, who is 6-foot-2 and weighs 220 pounds, said he was walking with a friend through a Daytona Beach neighborhood just before 9 p.m. Tuesday when the trio on bicycles started throwing sand and small rocks at them.
Then they got off their bikes and started throwing larger rocks, he said.
D'Amico said he fell into a wall after the 17-year-old punched him in the face, breaking the brick wall. One of the 10-year-olds then slammed a piece of the broken wall onto his face, he said.
"They were big kids for their age," D'Amico told the AP. "The little kid was taunting me. The big kid came over and just slugged me. If they just would have let me walk on, I would have walked on."
D'Amico, a New York native and day laborer, said he slid into homelessness after injuring his knee two years ago. Having no health insurance, he lost his car and a landscaping business. He could no longer make money as a baseball umpire because he couldn't run. Everything he owns now fits into a backpack, which he was wearing the night of the attack.
"I don't look that homeless. I'm not really dirty, slobby homeless," he said. "I'm familiar in the neighborhood. I don't know these kids, never seen them before."
A woman who answered the door at a trailer home where one of the 10-year-olds lives broke down in tears when a reporter asked about the attack.
"He's not a terror like everybody says. Sure he has problems, but I've been trying to get help," said the woman, who declined to give her name but said she was one of the boys' mothers.
A woman who answered the door at the home of the other 10-year-old refused comment.
The boys were known in the neighborhood for causing trouble, said Steve Smiley, who has lived there since 1985. "I avoided them. They were terrors," he said.
The case was the latest example of violence involving homeless people in Florida.

Wow, what is the world coming to? It is so sad when we have to worry about being attacked by small children. It is just so sad. I hope the 17 yr. old gets some time. I hope they get the other two the help they need and give them a good punishment. This is so unacceptable.

How TERRIBLE!! Ten years old?? That's freaking unbelievable! What the heck is this world coming to? How do these kids think that they are going to get away with this behavior? How could they do that to someone? Kids are becoming so aggressive and violent now-a-days. This just breaks my heart. I hope this is the last time those kids ever do something like that...but it probably won't be. And a ten year old being placed in the "system" at such a young age, he'll either have to learn to kick some butt or he'll be killed. It's a NO-WIN situation :-(

They should be dealt with very severely, certainly the 17 year old should be anyway. Some counselling, as well as detention and restorative justice (where the attackers get to meet their victim, hopefully impressing upon them the enormity of what they have done and the effect their violence has had) should be the solutions for the 10 year olds. I would also have to ask what kind of homes these kids come from that they were wandering around unsupervised hanging out with 17 year olds.

Above and beyond the disciplinary issues here, BabyKay, you presented one of my two questions: Why are these 10-year-olds permitted to hang with ANYbody over the age of 11 ??? And what in the Sam Hill were they doing outside of their homes at 9:00 at night ???

This is just rediculous. These kids are just pure evil. They are need to be put away.
The lady who answered the door at the trailer home and said "He's not a terror like everybody says", should be locked up too.
Why is her 10 year old son walking the streets of Dayton Beach at 9 p.m? These parents don't discipline their children and society has to pay for it.

I agree. You know, I once heard a mother describe a known gang member as someone who you would think is an angel. The boy she was describing was horrible and I hope he's been long locked up. I wonder if some of these mothers are living in a fantasy world, or they choose not to see their kids as they really are.

What are kids learning these days? This reminds me of the young kids that set fire to a shed after locking a mentally handicapped boy in it. This was last year and i can't remember what happened to the boys, but unfortunately kids don't seem to care anymore and its just not a US thing. I live in Canada...what are these parents doing???

That story is kind of unbelievable why would a wounded army veteran be poor and homeless. two 10 year olds a against an army guy... come on... wounded or not he could beat them up badly.

You know something like this gets me so angry , although they are kids there should be some kind of punishment that IS punishment , My hubby always says they would be as well to slap there fingers as it makes no difference , If they are capable of doing wrong then they should suffer the consequences . If they don't punish them when they are young I think they will just keep doing it until the are hardened criminals , This world is going mad xx

That is abhorent. I can't believe how violent our world has become. I agree with you, they did the crime they should do the time: even if they are ten years old. They are old enough to know right from wrong and should be punished to the full extent. That poor man that was beaten. Not only was he already on a "run of bad luck", but now he has to deal with this. Maybe the parent should have beat these two heathens a little more, then they would know what it feels like. Sorry, it just makes me angry. This is what happens when the government takes away the parents rights to dicipline their children. I'm not talking child abuse, but good old fashioned dicipline. I will be praying for that poor gentleman.

So the two 10 year olds already have a history of behavioral problems?I guess it would be best to do nothing (considering their age) until they actually kill someone ?I have an idea; why not stop the behavior now ?Be preventive rather than reactive.But I guess that will not happen as it may make sense.All kidding aside,will anything happen to the lads or will they not be taught anything from this? One of the mothers admits she is trying to get help for him.Don't let the boys just become statistics in the future.

I really hate to hear news like this. But, I don't think this is really a new thing. There have been street kids that do this kind of stuff all through the ages. What I don't like is the fact that if the adult were to fight back and strike one of those 10 year olds, chances are HE would be the one facing punishment.

OMG THATS AWFUL!! I mean ANYONE beating on a less fortunate person is of course horrible to begin wiht but for these kids to have the mindset to do it is not only terrible and mindboggling but so sad too ya knwo...what in the hell is goin on in their lives to turn them into such hateful, vile creatures ya know...Thats insane! and I'm sorry but the laws need to be changed IMO....they are definately old enough to know right from wrong and they were with an older kid so why couldnt they be tried as adults?

I hate seeing the homeless around town should be more shelters .
BUt kids have no business beating on them . Why do kids now aday think they have to hurt someone kids dont make since now. There is so much for them to do in town even in the country if they apply thereselves they can have fun.
back to these kids I hope they dont put the kid gloves on for them they need to go where they can learn a lesson and that would be detention!

that is terrible the 10 yr. old was probably fooling the older kids, I don't think he should be responsible. he is just 10. I don't think he would of had any idea to do that. if he was by himself, he was influence. if you ask me. that is my own opinion.

This is so horrific, that I am at a loss of words. My feelings are that they should be punished, all of them as adults. Children that behave like that will continue to through adult years, after hurting many inocent people on the way. It sounds harsh, but, they are not normal kids. I wonder what they have done to poor animals, if they can do this to humans.

That is terrible. I do not know how someone could make excuses for their sons to beat up on older people especially those who are lame and cannot run away or fight back. It is the evil powerful taking advantage of the weak and helpless. I think the parents of the boys should grab their sons and take them to one of those boot camps since they obviously are too young for jail time. But maybe instead of being based on age, maybe jail time should be based on size. If you have the strength of an adult, you should be in jail like an adult.
By the way, you should not copy and past from an article more than a sentence or two. That is against copyright laws.

This is truly sad. Those poor boys probably grew up in disfunctional homes with no real guidance and hanging out with whoever. They really do need to get help and if this is how it has to be, so be it. Things happen for a reason, unfortunately sometimes it has to hit rock bottom.
What made me mad about these two boys is how they are trying to blame the homeless guy now. That is shameful and I am glad the judge saw it that way too. They tried saying the man threw a garbage can lid at one of them and they were acting in self defense. Phooey Own up to it and grow to be a better person and get help!!

That is so horrible and you're right, I don't care how old they are, they are seriously demented and mentally damaged and they need to be locked up so they don't hurt anyone else. I mean, what drives a person to do that to another person? In Seventeen magazine I read an article similar to this. Some boys in their young teens, 13 or 14 or so I think, had murdered an old homeless man. The boys had went in the woods to "their secret spot" and found the homeless man resting there. They started calling him names and beating him. Then at last when he could hardly move or breathe anymore, they threw a big log on top of the old man and started jumping up and down on it, crushing almost all his ribs and bones and killing him. That story made me cry. He was a short, small, old homeless man who was doing nothing wrong. The better part of that story, however, is that these boys were actually sentenced jail time. They deserved it! The story was so much more gruesome and horrible than I can even describe. The thing is, why do people do this? It just upsets me so much.
