My Public Photo in the Internet was Printed in the Newspapers.

My students were calling me last June 12, 2008 saying that I was in the papers. I don't know how they picked that up but I confirmed it. My photo was really printed in Manila Bulletin. It was an article about pre-school education, and out of nothing, my photo while teaching was chosen. I was actually proud at first, but then my eyes dimmed when I found out that the article was really questioning the effects of pre-school.
Well. I just never thought that photos in the net can be freely picked up and be published without my knowledge.

I am sure there are laws that state that a photo of yourself cannot be printed without your say so and your authority, that is classed as copyright and infringement of your rights? Have you contacted the paper regarding this matter? I am not sure about different rules in different countries but in my country this would not be right and the paper would need to have asked permission beforehand. I hope you get this matter sorted.

That's one thing that I did not consider, I did not give an effort in contacting the paper org. But I'll give my shot this time. They actually violated my rights in doing so.

Actually the paper is in the wrong for publishing your photo without you having any knowledge of it, no matter the intent of the article written. Although it is rather easy to obtain anyone's picture from the net, before using it people are suppose to get the consent of the owner before publishing it elsewhere.
I would seriously think about getting in contact with the newspaper and let them know they had no right publishing your photo without your permission. Then start placing a copyright on all your photos you place online. It don't have to be anything fancy, just something like © copyright (your name here) 2008 (or whatever year it may be).

I heard theres a law where you need someones consent to take a picture of them, let alone print one in a newspaper without even asking!

I knew there's an existing law for that, but I was too negligent about it. My boss even discouraged me to file a case against them.

LOL. maybe you were be proud of for being known to the public but the saddest thing about it was the bad effect of your personality specially its' questioning about the effect of pre-school. many journalist search photos on the net to support their write-ups. our picture in the net is open to the public. to secure your photos you don't need to put tags so that they can't find immediately if they are using their search engine.

Honestly, I was too proud at the first glance, knowing that I am famous again. (Did I even become famous in the past? LOL..) But after reading the article, I was disheartened...

I really rocked the office that day but somehow I was saddened by the intention of the writer. He was pulling down the Pre-school effects and my photo was included there. I am a pre-school teacher and believe all the things Montessori, Froebel, Piaget, Bruner and lot more.
The child at the age range of 0-6 is still the best time to be trained for the basics suit for the best.

I am a photo manipulator, and I know how it is to feel to have your photo or work post in someonelses pages. I know the important of copyright is not too big deal in our country. But inorder for you to know if you have rights to sue, you need to check first as to where you publish or posted that photo.
Some photo sharing site, is strict in their TOS. They do not want to be charge for unlawful copyright infringement. But if your photo that was been used has been published or posted in a networking site, check out if you have sign up and agreed to the terms of their services. It will help you understand the consequences that you are facing right now. Most of this social networking site,does not protect you from this kind of people. It's like 'You post at your own risk'.

Actually, it wasn't really me who posted the picture. It was posted by our IT officer for marketing purposes. He posted it in our school's website, which I really don't know if it really cared having free photos on the net.

wow!! it is good news jaypeemanuel, im sure your so proud of it, but the thing is why they put your photo without your knowledge not because they will like or you like it but it will effect your pesonality & lot of people will be question & they will question you too. as you know magazine lot of rumors.

Actually it cannot. You have to give permission and you should call the paper right away and say that you did not give permission. If any, you should ask for financial compensation since they cannot take back all the papers. You also should look at the term of service of your particular web provider. They may say that they can allow anyone to publish your photo.
In any case, if you tell anyone that they have to get your permission to publish your photo then you have an out.

I have to check first and once I've confirmed that what they did was really something unlawful, they'll surely receive a subpoena for that.

wow. you became an instant celebrity! even if they were questioning the effects of pre-school on the caption. ^__^;; well as they say, bad publicity is still publicity. anyway, i don't agree with what they do. i think its not right to just get a picture of whoever from the internet and post it on a newspaper. even if you posted it in the internet, and people can download and save it, that doesn't mean that they can post it somewhere public like a newspaper. its kinda violating your privacy and propriety (whatever propriety means LOL). not to mention that the caption is kinda negative. whatever the caption is, it would project on the person on the picture. really bad publicity. if i were you i would have contacted Bulletin and complain about it.

I actually tried to contact them but it seemed that they were not paying attention. I already talked to my aunt just this morning and she told me that I should get a legal counsel for this matter. We are currently looking for a copy of the edition. I hope we find it easily and have it dealt accordingly.

Wow! That's happened in one in a million. It make you feel good I guess? Have you tried contacting the newspaper and tell them what you feel? They think since it is on the internet they can do what they want with your picture. I think we have still some legal right but it might not be very much unless you specifically said that they can't publish it without your permissions. At least they make you famous in some way but it may not be the way you want it. If you don't agree with the article and your picture was on it. I think it is ok to tell the paper what's your feeling and take on the article. Maybe you can share the day and page of the newspaper? I am interested to check it out.

It was dated June 12, 2008, Manila Bulletin, sorry but I forgot the page. I should have bought my own issue but to no avail I was not able to find one. I got informed of my photo the day after it was issued.

that is illegal...you can actually sue them for doing that. they use your photo to say bad things about pre-school teaching? that is against the law..it is the same as saying you are teaching bad things...stand-up for your right and sue them..for sure the school you are working with will support you.ask there help..they are also being criticized there because you are working with them.

I am actually wondering too if I can still file a case against them or should I just ignore it. Somehow, it makes me feel uncomfortable knowing that I was violated.

If it was without your permission you can take action against the newspaper. Warn them and see how they respond. If they don't seem to care, then take action. Contact a rival newspaper and tell them what this newspaper did - that may have interesting consequences!

That's strange. I often wonder about that.
Sometimes I'm driving and I see a billboard with a picture of a person on it.
I wonder if maybe there is a picture of ME on a billboard in China or somewhere.
(I'm not picking on China. I was just trying to name another country since I'm in the USA) Lol!

Well, having your face famed is quite awesome but I didn't like the article which was linked to my photo. It was an anti-preschool something, and that was something that I didn't like about it.

Yeah, but there are some comments here saying that there was a law protecting those who copy photos in the internet. They said that somehow, I was at fault for displaying it in public.

I think that's one good point to consider. Well, it wasn't really me who posted the picture but my IT officer. And I think Bulletin was not able to resist the charm of my face, it has somehow a funny charm.. LOL

Like a few individuals have already said, having anything pertaining to you (pictures/personal information) need to be authorized before being posted on anything, including Newspapers. It is a violation of your privacy and you can probably press charges or something. These kinds of things are applied as laws. And in some states, this certain law is dealt with appropriately and swiftly.
