No Breaks, No Lunch, 8 hours of work, sometimes more

My employer informed me today that the FLSA laws have changed. They are no longer required to give a food break to exempt employees (people that are paid a salary not hourly). Further he stated that according to the new laws he is only required to give me a 5 to 20 min of "rest" breaks during the day. Now I typically work an 9 to 10 hour day, it is rediculous that I am not allowed to take time to get food to eat, to make things worse, I can be told only 5 minutes of breaks the whole time I am at work. These seems terrribly unfair. What are your thoughts on this new law? He showed me the page from FLSA, it is real.

wow, that is horrible and i see it as an exploitation of employee. are you sure the pare is correct and i am surprise to see that the govt would approve it? how can that be when in the new century, there are so much emphasize on welfare and well-being of workforce. if that is the case, to which level does the new laws apply? is your employer your boss or only a supervisor. If he is a supervisor, is he binded by the new change too?

The last time I knew onlt twenty states actually make it mandatory foryour employer to give you a lunck break. If they do not deduct time from your check for breaks then if you are not in one of the selected stated then it is really hard to fight it. Where I work we sign an agreement stating that thirty minutes will be deducted from our check for each day we work to cover for our luch break. It doesn't matter whether we go or not we are deducted for it. Knowing that though we all try and make the time to get away for awhile. I really hope that more states will start to look into this as it can cause some serious problems if people are expected to work long hours with no breaks. I know most companies do give you breaks but I have heard of a few that don't give you much. If I were you though I would look up the laws for your state and learn them all so that you know your rights.

It is very bad law. just 5 to 20 minutes of rest is ridiculous. it is not going to help.I think they are just looking at their revenue.

I don't get paid for my lunch hour, I don't see where it helps.

that seems so unfair! is there anyone else that you can complain to? ie like a government agency? sheesh! it would be nice if your boss gave you a few perks, i guess if he is going to be that mean, he is not going to have very happy employees to be sure!

It is the Federal Government that changed the law, who is above them, nobody really. God, this sucks. I feel like my company is taking advantage of the economy because it is not like people can quit and easily find a new job.

That is crazy. Everyone at the very leaast needs time to eat. I would refuse to work for an employer that did not allow me that. I think you need to start seeking for a different employeer!

Find another job and then quit. If everyone stops being exploited, employers will be forced to change their policies. Or make enough money on MyLot to quit your job!

Honestly, I don't think it is humanly possible for me to replace my salary on Mylot, I am a midlevel manager.

Mid level managers are in demand. I am confident that you will find another job. Ignore anyone who says there are no jobs because of the economy.

That is freakin' ridiculous. I can't believe an employer would want to follow such ridiculous laws. I will have to look that one up. Seems a bit extreme to me and more like sweatshop rules.

wow I just looked up flsa regulations (most pertain to overtime pay for non-exempt or hourly wage workers) and according to what I have read lunch breaks and all other breaks are solely up to the employer as to whether they want to provide them for thier employees exempt or non-exempt. According to what I have read FLSA does not regulate such things.

If I were you, I'd be hiring a headhunter to find a new job. I'd also be taking time to look for a new job. We are only under the restrictions we accept for ourselves. If you make it clear to your boss that you are willing to go on under the new requirements, then you are voting with your feet. There are worse things in life than midlife career changes.

Wow, that is quite amazing. A few years ago I heard that some game developers (notoriously overworked) are taking an hourly wage instead of a salary so that they can get paid overtime for working 80 hours a week. I am surprised, though, that the laws don't give you any lunch time. I am even more surprised that your company chose to take advantage of this and not give you any... guess you can get them back by spending work time here on myLot if you dare :).

That is really unfair, but do yo think there is an alternative? If you can get an alternate job where you can get breaks and the employer is a little more liberal that woud be better. more often than not you do not require a break if you have a lot of work to keep you busy. if ther eis no work yo tend to get bored and tire out faster.

Working 9 to 10 hours a day and then being told that basically the new law lets your employer treat people like slaves. Yeah that is sure to boost worker moral. So people will start focusing on this new stupid law rather than trying to get a higher rate for minimum wage. So work all day and well into the wee hours of the night, crappy wages, and no lunch or decent break time... and they wonder why criminal activity is at a all time high... at least prisoners are given a better work labor deal dang it!

ok i just wana say that i am not sure the true meaning of falsa so every organiztion has his own rules and regulation and i also did'nt known that where r u living i am living in pakistan and there are such institute in which the break time is not allowed to there employees which is totaly wrong from my point of view i think they must give him such a time for relaxtion

Economy is very bad and they come up with this law. I found it is unreasonable. Actually I like to work and sometimes even more than 16 hours. Without break is really unreasonable. Staff is always the most important asset of a company. If human are force to work long hour without break, the production will decrease. What is the point of hiring staff. Should talk to employer regarding this matter and give the humble opinion.

Where in the heck do you work and are hiring.I would learn to eat my luch in the restroom if you get a restroom break. The law may be right but is enforcing it. The minute he does, every one slow down, go to the restroom. Stall all the time you can because you are getting paid anyway. Your not on the clock hourly, so your check will be there payday.

wow..this sounds so crazy i cant imagine myself working a 8 hours shift without a proper lunch or a dinner break...how cruel can this world actually get...and that too this is a law which has actually been passed for real..what have we become now.... machines? gosh even machines need oiling from time to time....these laws wont even let that happen i guess!! sad sad situation though

Right now, I am at least lucky that my current employer doesn’t really give us time to go on break, as long as we feel like it and our work is done or okay to leave for a while then we can eat on our pantry for half an hour or sometimes an hour. Though right now, I am planning to just finish my bond then look for another work, something that I can use my skill at.. I am ok with this one so far… Cheers!

If you have no union, I would call myself and ask for the laws. It can not be working without a break! I know places that the break is taken from the workers time, so instead of 8 hours, you work 8.5 and get paid for 8.That's more likely.You have to have your break time.Even a dog is aloud to rest. You're the only worker?Why don't you speak with the others too? Make the employer understand that in order to give good quality you have to have a rest, you're not a robot. Even robots are aloud to charge their batteries...
